Should Yahoo be allowed to promote and encourage employees to chat discreetly during their work hours.?

On my Yahoo home page appears an advert encouraging yahoo subscribers to chat on Yahoo during work hours . Surely this is not ethical and causes employees of a company to break rules concerning their employment contracts.
